Using Clutter

Terms of Service

These terms govern your use of Clutter's websites, application, and related services (the "Service"), operated by BangClutter Inc., a C corporation ("Clutter," "we," "us," or "our"). By using the Service, you agree to these terms. If you do not agree, do not use the Service.

1. Eligibility and your account

You must be at least 18 years old and legally able to enter into these terms. If you use Clutter on behalf of an organization, you represent that you have authority to bind it, and "you" includes that organization.

Provide accurate account information, protect your connected accounts, and notify us if you suspect unauthorized access. You are responsible for your use of the Service and for making sure you have permission to connect accounts, provide content, and invite or contact others.

2. The Service and connected accounts

Clutter helps you manage communications, collaborate in workspaces, and use features such as search, summaries, memory, recommendations, and Assist. Connecting Google, Slack, or another provider authorizes Clutter to access and process information and carry out supported operations within the permissions you grant.

Third-party services have their own terms, privacy policies, limits, and availability. Changes or interruptions to those services may affect Clutter. You may disconnect a provider or revoke its permissions, although some features will then stop working.

3. Your content and sharing

You retain your rights in messages, files, and other content you provide. You grant us a limited, non-exclusive license to host, copy, transmit, display, and process that content only as needed to operate the Service for you, provide the features described in our Privacy Policy, and meet legal obligations. This includes processing by service providers working on our behalf. It does not transfer ownership of your content.

You are responsible for the content you submit and the permissions needed to use it. Check recipients, workspace membership, visibility, and action confirmations before sending or sharing information. Other participants may retain messages or files they receive. Deleting your account or leaving a workspace does not necessarily remove their copies or shared records.

4. Acceptable use

You must not use Clutter to:

• Break the law, violate others' privacy or intellectual property rights, or send unlawful, fraudulent, threatening, or abusive content.
• Send spam, impersonate others, distribute malware, or misrepresent your authority to use an account.
• Access accounts, workspaces, or data without permission; bypass access controls or usage limits; or interfere with the security or operation of the Service.
• Probe or exploit vulnerabilities without authorization, or use the Service in violation of a connected provider's rules.

5. AI features

AI features can generate inaccurate, incomplete, or misleading information. Review summaries, suggested actions, drafts, and other output before relying on them. You remain responsible for messages you send and actions you authorize. AI output is not professional advice, and Clutter does not guarantee that generated content is unique or free of third-party rights.

Some AI processing runs in the background to organize information and maintain summaries or memory. Our Privacy Policy describes the information processed and the service providers involved.

6. Availability, beta features, and charges

The Service may include beta or experimental features. Features, limits, and availability may change, and interruptions or errors can occur. Maintain independent copies of information you need to preserve. Clutter is not intended for emergency communications or situations requiring guaranteed delivery.

Any paid plan, renewal terms, and applicable charges will be presented separately before you agree to purchase. These terms alone do not authorize a charge or subscription.

7. Our rights

We and our licensors retain rights in the Service's software, design, branding, and other materials, excluding your content. Subject to these terms, you may use the Service for its intended purposes. You may not copy, sell, or redistribute the Service, or use our branding in a way that suggests an endorsement, without permission or another legal right to do so.

8. Suspension and account closure

You may stop using Clutter at any time and request deletion using Delete my Clutter account in the app or by contacting us. Deletion may require identity verification and resolution of shared-workspace ownership. It does not delete your external email or Slack account.

We may restrict or suspend access when reasonably necessary to address violations of these terms, security risks, legal requirements, or harm to the Service or others. Where practical and lawful, we will provide notice and an opportunity to resolve the issue. If we discontinue the Service, we will provide reasonable notice where practical.

Information remaining after closure is handled as described in the Privacy Policy. Terms concerning content already shared, intellectual property, liability, and disputes continue where needed to give them effect.

9. Disclaimers and liability

To the extent permitted by law, the Service is provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted operation, complete accuracy, or error-free delivery and synchronization.

To the extent permitted by law, neither party is liable to the other for indirect, incidental, special, or consequential losses arising from use of the Service, including lost profits or business opportunities. Nothing in these terms excludes liability for fraud, willful misconduct, or any liability or consumer right that cannot lawfully be excluded or limited.

10. Changes, concerns, and contact

We may update these terms as the Service changes. We will post the revised terms and effective date here and provide notice of material changes where required. Changes take effect prospectively. If you disagree with an update, you may stop using the Service; continued use after an update takes effect constitutes acceptance where permitted by law.

If a provision is unenforceable, the remaining provisions continue to apply. These terms do not remove mandatory rights under the laws that apply to you.
